GRAN TURISMO® ACADEMY 2014 CANADA ONLINE CONTEST OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER, WIN, OR CLAIM A PRIZE. A PURCHASE DOES NOT IMPROVE AN ENTRANT'S CHANCES OF WINNING.
OPEN ONLY TO ELIGIBLE LEGAL RESIDENTS OF CANADA (EXCLUDING QUEBEC) WHO ARE AT LEAST 18 YEARS OF AGE IN THEIR JURISDICTION OF RESIDENCE AS OF MAY 19, 2014.
VOID WHERE PROHIBITED.

The Gran Turismo Academy Canada (“GT Academy”) online contest (“Contest”) is open only to legal residents of Canada (excluding the Province of Quebec). Do not enter this Contest if you are not a legal resident of Canada (excluding the Province of Quebec) at the time of entry.

1.Contest. By participating in the Contest, each Contestant (defined below) fully and unconditionally accepts and agrees to comply with and abide by these rules (“Official Rules”) and the decisions of Sponsor and Administrator (as defined below), which are final and binding in all respects. Sponsor is responsible for the selection of winners and the Contest’s overall management. Contestants should address all questions, comments or concerns related to the Contest solely and directly to Sponsor.
2.Sponsor. Contest sponsors are (i) Sony Computer Entertainment America LLC, located at 2207 Bridgepointe Parkway, San Mateo, CA 94404 (“SCEA”), and (ii) Nissan North America, Inc., located at One Nissan Way, Franklin, TN 37067 (”Nissan,” and collectively with SCEA, “Sponsor”). This contest will be administered by Prize Logic, LLC, 25200 Telegraph Road, Suite 405, Southfield, MI 48033 (“Administrator”).
3.Eligibility.
3.1The Contest is open only to legal residents of Canada (excluding the Province of Quebec) (“Contestants”) who, as of May 19, 2014: (i) possess a valid, active PlayStation® Network (“PSN”) account in their own name and in good standing with SCEA, (ii) have internet access, access to a PlayStation®3 computer entertainment system and a valid version of GT6; and (iii) are at least 18 years of age. If 18 is not the age of majority in the Contestant’s residing jurisdiction, the Contestant must have parental/guardian consent to participate in this Contest.
3.2Employees, officers, directors, and representatives of SCEA, Nissan, Administrator, and their respective parent companies, affiliates, subsidiaries, related companies, and agencies (including advertising, promotion and web design agencies), and their immediate families (defined as parents, children, siblings, and spouse and their respective spouses, regardless of where they reside) and those living in the same household, whether or not related, are not eligible to enter or win.
3.3Void in the Province of Quebec, and where prohibited or restricted by law.
3.4Contestants who have previously attended the GT Academy Boot Camp at Silverstone Race Circuit in the United Kingdom are not eligible to enter.
4.Timing. The Contest begins on May 19, 2014 at 12:01AM (PST) and ends on June 16, 2014 at 11:59PM (PST) (“Contest Term”).
5.Registration.
5.1Contestants must register using a registration page that will be provided as part of the online qualification module ("OQM") that will become available within the Gran Turismo 6 video game ("GT6") on May 19, 2014. Each contestant must provide all of the contact information requested by Sponsor to register to participate in the Contest. Failure to provide complete, truthful, and accurate information may result in the Contestant’s disqualification in Sponsor’s sole discretion.
5.2Each contestant must update his/her PSN account information with accurate name, age, home address, phone number, country of legal residence, and e-mail address information so Sponsor may notify the Contestant of his/her standing in the Contest.
5.3Contestants may register to enter the Contest only once. If a Contestant registers more than once, Sponsor may, in its sole discretion, disqualify some or all of that Contestant’s entries.
5.4Potentially winning Contestants will be required to verify their eligibility and contact information and provide certain tax-related information by signing and sending to Sponsor an Affidavit of Eligibility and Release and IRS Form W-8BEN, W-9 or other applicable tax documentation to verify the Contestant’s status as a U.S. or non-U.S. person before Sponsor will award any Prize. Contestants must have a passport valid for 6 months or more prior to the date of departure, be in possession of all required travel documentation, and be legally able to travel to the United States of America.
6.Entry and Registration.
6.1Contestants must update their version of GT6 after 12:01am PST on Monday, April 21, 2014 to download and install the GT Academy 2014 online qualification module (“OQM”).
6.2Contestants must then log into their PSN account, and successfully complete four (4) progressive rounds of qualification racing included in the OQM within the Contest Term. Contestants must complete all previous rounds before the subsequent round will be unlocked.
6.3Contest registration will open on May 19, 2014 and will only be available to those Contestants who have successfully completed qualifying rounds 1 and 2. To register, Contestants who have successfully completed qualifying rounds 1 and 2 must re-launch GT6 after May 19, 2014 and provide their PSN account information within the OQM.
6.4Each round will be unlocked at 12:01am (PST) on the following dates:
Round 1: April 21, 2014
Round 2: May 5, 2014
Round 3: May 19, 2014
Round 4: June 2, 2014 (“Qualification Round”)
7.Qualification.
7.1All Contestants must compete using identical vehicles and tracks, the specifications of which will be automatically determined by the OQM at the start of each race.
7.2A Contestant’s fastest race time in the Qualification Round, as determined by the OQM and posted on the Contest leaderboard, will be that contestant’s qualification time (“Qualification Time”).
7.3Once the Qualification Round is unlocked, Contestants may race in the Qualification Round an unlimited number of times during the Contest Term. A Contestant cannot post a new Qualification Time to the leaderboard until the Contestant achieves a Qualification Time that is faster than his or her previous Qualification Time as determined by the OQM. If a contestant betters his or her previous fastest Qualification Time, the updated Qualification Time for that event will be recorded and reflected on the Contest leaderboard. It may take up to two hours for leaderboards to update or refresh. Qualification Times are ranked in order of fastest to slowest.
7.4Leaderboards can be viewed from within GT6 and at www.us.gran-turismo.com.
8.Winner Selection.
8.1“Potential Winners” will be the 4 Contestants with the fastest Qualification Time. In the event of a tie, the Contestant who achieves the fastest race time in the fewest attempts will be deemed to have the fastest Qualification Time.
8.2Potential Winners will be contacted directly by Sponsor by email and telephone at the address and number provided to confirm their eligibility and availability to travel to the GT Academy North American Semi-Finals/Finals ("North American Finals") to take place on or around July 11, 2014 in New York, NY. Potential Winners must respond to Sponsor by the same means as receipt of the notification within five (5) business days of the date on which Sponsor sent the notification. Potential Winners must meet the eligibility requirements described in the Addendum attached hereto to participate in the North America Finals.
8.3All decisions regarding Potential Winner selection are in Sponsor’s sole discretion, and are final and binding.
8.4Sponsor is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions that may limit a Contestant’s ability to participate in, post a Qualification Time for, send or receive communications to or from Sponsor regarding, or win the Contest.
8.5If Sponsor cannot verify a Potential Winner’s age, legal residency, contact information, or any other factor deemed essential by Sponsor for participation in the North American Finals, or if a Potential Winner is not available to attend the North American Finals, Sponsor may select an alternate Potential Winner beginning with the Contestant with the next fastest Qualification Time.
9.Changes, Cancellation and Disqualification.
9.1Sponsor reserves the right to change Contest, and Contest registration, start and end dates and times in its sole discretion at any time and without prior notice to Contestants.
9.2Any updates Sponsor may elect to provide to Contestants will be posted at www.us.gran-turismo.com.
9.3Sponsor reserves the right in its sole discretion to modify, cancel or suspend the Contest should disruptions, interruptions, hardware or software malfunctions, data loss or corruption, a virus, bugs or any other cause beyond Sponsor’s control compromise or corrupt the administration, security or proper play of the Contest.
9.4Conduct that in Sponsor’s sole discretion (i) is unsportsmanlike, including the use of technical, automated, or other means to gain an unfair advantage, or disrupt or interfere with other Contestants’ participation in or the administration of the Contest, (ii) is disrespectful or inappropriate, whether directed at Sponsor, its employees, or other Contestants , (iii) violates or infringes any rights of any other party, including but not limited to copyright, trademark, privacy, publicity, or any other intellectual property rights, or (iv) is harmful to or inconsistent with the positive image or reputation of Sponsor or GT6, may result in disqualification from the Contest.
10.Prizes.
10.1Those qualifying Potential Winners who have met all requirements in these Contest Rules and been approved by Sponsor to proceed to the North American Finals (“Semi-Finalists”) will win a prize package to attend and participate in the North American Finals.
10.2The prize package (“Prize”) consists of: (i) one roundtrip coach airfare to the North American Finals, (ii) standard hotel accommodations for two nights, (iii) ground transportation to and from the destination airport and the North American Finals ((i)-(iii) collectively referred to as the “North American Finals Trip”), (iv) a Tax Gross Up Payment (as defined in Section 10.3) below, and (v) a chance to race and compete at GT Academy Boot Camp. There are 4 Prizes available to be won. The approximate retail value (“ARV”) of each Prize is CAD$5,714 (consisting of the North American Finals Trip with an ARV of CAD$4000 and the Tax Gross-Up Payment with an ARV of CAD$1,714). The total ARV of all 4 Prizes is up to CAD$22,857. The actual Prize value and ARV may vary depending on the city of departure and fluctuations in airfare charges, hotel rooms, and other trip-related elements. Any difference between the actual value of a Prize and the stated ARV (if less than the actual value) will not be awarded in the form of cash or other value. All Prize-related travel must be taken on the designated dates, according to Sponsor’s directions or the Prize will be forfeited and awarded to an alternate winner, time permitting.
10.3Sponsor will deposit an amount with the U.S. Internal Revenue Service that is equal to Sponsor’s U.S. Federal income tax withholding obligation on the actual fair market value of the Prize for each Semi-Finalist who is a non-U.S. person under U.S. tax laws (“Tax Gross-Up Payment”). The Tax Gross-Up Payment is treated as additional Prize value to the Semi-Finalist. The amount of the Tax Gross-Up Payment will be computed based upon the actual value of the North American Finals Trip, as determined by Sponsor in its sole discretion, and will be calculated using a withholding tax rate of 30%. The Semi-Finalist is solely responsible for all tax liabilities that exceed, or are in addition to, the Tax Gross-Up Payment. Sponsor will not provide any further assistance toward Semi-Finalists’ tax obligations. The Semi-Finalist is solely responsible for all individual tax filing obligations as a result of receiving the Prize. Sponsor will report the actual fair market value of the Prize (including any Tax Gross Up Payment) as taxable income to the Semi-Finalists and applicable U.S. taxing authorities on a IRS Form 1042-S or other applicable tax form, as required by law. Contestants should consult with a tax advisor if they have any questions about the tax implications of participating in this Contest.
10.4If a winner resides within 200 miles of the North American Finals, Sponsor may provide round-trip ground transportation for the winner from the winner’s residence to the hotel in lieu of airfare and no further compensation will be awarded.
10.5All Prize-related travel arrangements will be administered by Sponsor’s authorized designee. All travel must be booked prior to departure. Prize travel is subject to capacity controls, availability, weather, seasonal influences and certain other restrictions, all of which are subject to change. No changes will be made to travel details once any element(s) of the travel arrangements have been booked, except at Sponsor’s sole discretion. All airline tickets issued in conjunction with a Prize are not eligible for upgrades, frequent flyer miles or any other promotional benefit. Sponsor will not replace any lost or stolen tickets (including any event tickets or admission passes), travel vouchers or certificates or similar items once they are in a winner’s possession. Sponsor will determine flight itinerary in its sole discretion. Once hotel and flight arrangements have been confirmed, no changes will be allowed except by Sponsor in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules and those set forth by Sponsor’s air travel prize supplier, as detailed in the passenger ticket contract issued by such supplier.
10.6Sponsor is not liable if a winner is refused entry or re-entry into the US or Canada. If, for any reason, travel is delayed, impeded or refused by Canada, US, or other immigration/border control authorities, the Prize may be forfeited (in whole or in part) and winner will be solely responsible for any additional expenses incurred. Each winner hereby acknowledges that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance for any part of the Prize. It is the responsibility of each winner to arrive at the designated gateway airport in time for each flight that is part of a Prize. Each winner is responsible for all in-room charges (e.g., mini-bar, movies), telephone calls, meals, beverages, gratuities, upgrades, personal incidentals, amenities and any other fees and expenses not specifically mentioned in these Official Rules. Each winner will be required to provide a major credit card upon hotel check-in and all in-room charges will be charged to the credit card. Any damage to the room attributed to a winner will be the responsibility of the winner.
10.7Sponsor bears no responsibility if any event, element or detail of a Prize is canceled, postponed or becomes unavailable for any reason. Should any event, element or detail of a Prize become unavailable, the Sponsor shall have no obligation to the winner aside from providing the travel portion of the Prize, minus any unavailable event, element or detail. Each winner shall be subject to all terms and conditions printed on any ticket issues in conjunction with a Prize.
10.8At the North American Finals, Semi-Finalists will compete and race against each other and the winners of a U.S. online contest using GT6 for one of 12 North American Finals slots to attend and compete in the GT Academy Boot Camp, which will take place at Silverstone Circuit in the United Kingdom. Separate contest rules apply to each of the North American Finals and GT Academy Boot Camp. Semi-Finalists must meet the eligibility requirements described in the Addendum attached hereto to participate in the North American Finals and GT Academy Boot Camp.
10.9A Semi-Finalist will forfeit his/her Prize if such Semi-Finalist: (i) is unable to travel to and attend the North American Finals during the designated time period, (ii) does not return the signed required Declaration of Eligibility and Release and applicable tax forms, within the required timeframe that verifies the requested information, or (iii) fails to comply in any other manner with the Official Rules, as determined by Sponsor in Sponsor’s sole discretion.
11.Potential Winner Eligibility and Release.
11.1Potential Winners must: (i) respond to Sponsor’s notification in accordance with Section 9.2, and (ii) execute and return a Declaration of Eligibility and Release to Sponsor and fully complete, execute and return the applicable tax forms, each within seven (7) days of receipt. Failure to do any of the foregoing may result in disqualification and Prize forfeiture.
11.2Return of any prize or prize notification as undeliverable will result in disqualification, and an alternate Potential Winner will be selected.
11.3Semi-Finalists will be required to sign an image release acceptable to Sponsor in order to advance to the North American Finals.
11.4Any Contestant who does not meet the requirements of these Official Rules may forfeit Prizes or be disqualified from the Contest in Sponsor’s sole discretion.
11.5Unclaimed prizes may not be awarded to other contestants.
11.6No tickets or other travel documentation will be issued by Sponsor to any Potential Winner who has not signed and timely returned all required documents, including the required Declaration of Eligibility and Release.
11.7Prizes are not transferable, assignable, or redeemable for cash, and may not be substituted.
11.8A Semi-Finalist’s acceptance of a Prize constitutes his or her permission (except where prohibited) for Sponsor to use Semi-Finalist’s name, likeness, biography, statements, photos and any other similar materials for marketing, promotional and publicity purposes without any limitation, and without any additional compensation or notice to Semi-Finalist of any kind.
11.9Neither Sponsor nor Sponsor’s parent, affiliates, subsidiaries, divisions or related companies, officers, directors, agents, employees, representatives, successors, and assigns are responsible for any damages, taxes (except as set forth in Section 10.3), or expenses that Semi-Finalists might incur as a result of this Contest or receipt of a Prize or any portion of a Prize.
12.Limitation of Liability. Contestants hereby release SCEA, Nissan, and their respective parents, subsidiaries, agencies, divisions, affiliates, officers, directors, agents, employees, representatives, successors, and assigns from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including property damage, personal injury or death that may occur in connection with preparation for, travel to or from, or participation in the Contest, or possession, acceptance or use or misuse of any Prize or participation in any Contest-related activity, and any claims based on publicity rights, copyright or trademark infringement, defamation or invasion of privacy and merchandise delivery. Neither SCEA, Nissan, nor their respective parents, subsidiaries, agencies, divisions, affiliates, officers, directors, agents, employees, agents, representatives, successors, and assigns, Prize providers, related companies or event administrators, are responsible for any damages, taxes, or expenses that winners may incur as a result of the Contest or receipt of a Prize.
13.Use of Data. Sponsor will be collecting personal data about Contestants online, in accordance with its privacy policy. Please review Sponsor’s privacy policy at http://www.sonyentertainmentnetwork.com/privacy-policy/ and http://www.nissanusa.com/global/privacy.html. By participating in the Contest, Contestants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
14.Winners’ List. To obtain a list of Semi-Finalists, send a self-addressed envelope to: “GT Academy 2014” Canada Winners List, c/o Marketing Dept., 2207 Bridgepointe Parkway, San Mateo, CA 94404. Sponsor will fulfill winner’s list requests within 4-6 weeks after all Prizes have been awarded. Requests for winners list must be received no later than December 31, 2014.
15.Governing Law.The laws of the State of California, excluding that body of law related to choice of laws, govern these Official Rules and any dispute between Contestants and Sponsor.

Addendum

1.Semi--Finalists must participate in and pass a mandatory health screening conducted by a vendor selected by Sponsor for physical fitness and vision prior to the start of the GT Academy Boot Camp, and be in good general health in accordance with Motor Sports Association (“MSA”) medical requirements (details can be found at: http://www.msauk.org/uploadedfiles/msa_forms/2014_licence_notes.pdf ).THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, THE MOTOR SPORTS ASSOCIATION. YOU ARE PROVIDING YOUR INFORMATION TO SPONSOR AND NOT TO THE MOTOR SPORTS ASSOCIATION. Health screening may include:
a.Eyesight test (with glasses or corrective lenses if necessary). Semi-Finalists must declare color-blindness, which in extreme cases may preclude a Semi-Finalist from participation in GT Academy Boot Camp.
b.Body mass index and blood pressure exam to ensure Semi-Finalists are within the height and weight requirements to use the safety harnesses and other equipment required to participate in the GT Academy Boot Camp.
c.Testing for free movement of all joints.
d.Testing for pre-existing neck or head injuries.
2.Semi-Finalists must have a valid, unsuspended Canada driver’s license and passport, and be in good standing in accordance with the rules and regulations of the issuing body.
3.Semi-Finalists must not have:
a.A Driving Under the Influence (DUI) conviction, or a Driving While Intoxicated (DWI) conviction;
b.At entry or at any time during the Contest, any pending felony charges/indictments, felony convictions or outstanding warrants, including a reckless driving conviction;
c.An existing competition driving contract with any motor sports team, body, agent or management company that conflicts with his/her ability to accept the Prize;
d.A current or previous National A or superior MSA license or equivalent in another Fédération Internationale de l'Automobile (FIA) recognized ASN; or
e.Competed in a national level Karting Championship for more than two full seasons.
