GT ACADEMY 2013 NATIONAL FINAL CONTEST OFFICIAL RULES

To enter the GT Academy 2013 National Finals Contest (“Contest”), you must be either a GT Academy 2013 Online Contest winner or a Racer X Contest winner and must be 18 years of age as of June 13, 2013.

SPONSORS: The Contest Sponsors are Sony Computer Entertainment America LLC, 2207 Bridgepointe Parkway, San Mateo, CA 94404 and Nissan North America, Inc., One Nissan Way, Franklin, TN 37067 (“Sponsors”).

CONTEST DATES: The Contest begins on August 23, 2013 at 6:00 AM PST and ends August 24, 2013 at 7:00 PM PST. Please note, due to technical and logistical factors, Sponsors reserve the right to change Contest start and end dates. See www.us.gran-turismo.com for updated Contest dates. Any change in start or end dates from the Official Rules will be posted at www.us.gran-turismo.com and an email will be sent to the registered contestants.

CONTEST RACES: The 32 contestants are subject to background and medical screening as defined in Addendum A. If a contestant does not pass the background and medical screening process, Sponsors may select an alternate contestant for any winning contestant who does not pass the necessary screening process.

Sponsors reserve the right in their sole discretion to modify, cancel or suspend this Contest and to disqualify any contestant or Winner, at any time, for any reason.

ROUND ONE:

At the beginning of the National Final Contest, each contestant will have the opportunity to race and complete three laps, with the third lap being used as the official lap time for ranking purposes. The 32 contestants will be divided into eight groups of four contestants each. Groups will be based on the lap time posted by each contestant as described above. Each group of four will race against each other twice. Each contestant will earn points based on finishing positions in each event in his or her group. Points will be awarded as follows:

6 points for placing first
3 points for placing second
1 point for placing third
0 points for placing fourth
ROUND TWO

Points from Round One are totaled and contestants are ranked. In the event of a tie, the fastest lap time prevails. Contestants are slotted into groups of 4 based on Round One point totals. Each group of four will race each other twice, earning points for each race.

ROUND THREE

Points from Round One and Round Two are totaled. In the event of a tie, the fastest Round Two lap time prevails. Contestants are slotted into groups of four based on Round One and RoundTwo point totals. Each group of four will race each other twice, earning points for each race.

Round One, Round Two and Round Three Three points are totaled and racers ranked. In the event of a tie, the fastest Round Three lap time prevails. This final point total will determine the overall ranking of each of the 32 contestants.

Race difficulty gradually increases per round of the National Finals, with later races being in more difficult cars and tracks. Sponsors will select the tracks, number of laps, cars, and car settings prior to start of each round.

Sponsors may have one or more race judges on site to monitor contestants during competition. The race judges (whose judgment on all race matters is final) may monitor races and may issue warnings for behaviors that violate standard rules for professional racing. Examples include:

• A slower driver that is holding another driver up can be asked to move over. Failure to comply would result in a warning.
• Any driver that is overly aggressive or hits another driver
• A driver deliberately cutting a corner
• A driver not moving over when asked

Each contestant is allowed two warnings. A contestant receiving three warnings will be disqualified from the race. Certain flagrant behaviors may also result in immediate disqualification at the sole discretion of Sponsors.

After the first round of the National Finals, the contestants will compete in a series of challenges that will be announced during the event. Sponsors reserve the right to change challenges at any time during the National Finals

At the completion of the National Finals, the top contestants will win the Grand Prize.

The top contestants will be put through a psychological evaluation that includes a one hour in person interview and an MMPI-2 test on each contestant. If a contestant does not pass the psychological evaluation, Sponsors may select an alternate contestant to replace the winning contestant who does not pass the necessary screening process.

PRIZES:
National Finals Prize: Trip to National Finals (32 Prizes):

The 32 contestants with the fastest race time at the end of the Online Qualifier Time Trial 5 will win a prize package to the GT Academy National Finals (the “National Finals”) that will take place on or around August 24-25, 2013 (“National Finals Prize”). The National Finals Prize includes one roundtrip airfare to the National Finals, hotel accommodations for two nights, ground transportation to and from the airport and the National Finals, and a chance to race and compete at GT Academy (Approximate retail value (“ARV”) of each National Finals Prize is $3,000.00. Total ARV of all 32 National Finals Prizes is $96,000.00). At the National Finals, the contestants (along with one additional contestant who qualified for the National Finals through a different competition – the 2013 Racer X Contest) will compete and race for one of the top spots to compete in GT Academy, which will take place at Silverstone Circuit in the United Kingdom, where the contestant will attend GT Academy Boot Camp (the “Grand Prize”) and compete for the ultimate prize of becoming a professional race car driver (the “Ultimate Prize”). Separate contest rules apply to the Ultimate Prize. A contestant will forfeit their National Finals Prize if that contestant is unable to travel during the designated time period, if that contestant does not return the required Affidavit of Eligibility and Release and IRS Form W-9 within the required timeframe, and or if that contestant fails to comply in any other manner with these Contest rules, at Sponsor’s sole discretion. A major credit card may be necessary for hotel check in and for any incidental charges that are billed to the room. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. All expenses and incidental travel costs not expressly stated in the package description above, including other ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are contestants’ sole responsibility. If Sponsor determines that air travel is not required due to a contestant’s proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsor’s sole discretion.

Grand Prize: Trip to Silverstone and GT Academy:

The top contestants at the end of the National Finals win the chance to participate in GT Academy which will take place at Silverstone Circuit in the United Kingdom, where the contestants will attend GT Academy Boot Camp (the “Grand Prize”) and compete for the ultimate prize of a chance to become a professional race car driver. The Grand Prize includes one economy round-trip airfare and one week of accommodation that includes room, board, European transport and driving instruction at the GT Academy Boot Camp (Approximate retail value of each Grand Prize is $20,000.00). A National Final’s qualifying contestant’s Grand Prize will be forfeited if that contestant is unable to travel during designated time period, or if that contestant does not return the required Affidavit of Eligibility and Release and IRS Form W-9 within the required timeframe, does not meet the requirements of Addendum A attached, or otherwise does not comply with these Contest rules. A major credit card may be necessary for hotel check in, and for any incidental charges that are billed to the room. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Ultimate Prize: GT Academy Winner

Separate contest rules, ARV, and prize information apply to the Ultimate Prize of becoming a professional race car driver.

WINNERS: Winners will be selected based on overall point totals and challenges completed. The top performers advance to the next round of the National Finals.

All decisions regarding all matters of this Contest are at Sponsors’ discretion and are final and binding. Sponsors reserve the right to disqualify a Winner at any time, for any reason, at Sponsor’s sole discretion. Sponsors are not responsible for logistical issues that may arise, or technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions that may limit a contestant’s ability to participate in the Contest. Sponsors reserve the right in their sole discretion to modify, cancel or suspend this Contest should administrative or logistical issues arise, or disruptions, interruptions, hardware or software malfunctions, data loss or corruption, viruses or bugs, or any other cause beyond Sponsors’ control, compromise or corrupt the administration, security or proper play of this Contest. Additionally, Sponsors reserve the right to modify rules and the number of contestants as needed to enable the successful conduct and completion of the Contest.

ELIGIBILITY, RELEASE, AND TAX INFORMATION: Contest open to only legal U.S. residents who are 18 years of age or older as of June 13, 2013 and who posted one of 31 fastest race times in the GT Academy Online Contest or is the winning contestant during the 2013 Racer X Contest. Previous GT Academy contestants (contestants who attended the GT Academy Boot Camp in any prior year) are not eligible to participate. Unsportsmanlike conduct, disrespectful or inappropriate actions directed at Sponsor or its employees or other contestants, or other behavior deemed at the sole discretion of Sponsor to be harmful to or inconsistent with the image or reputation of Sponsor or the implementation of the Contest may result in disqualification from this Contest in Sponsor’s sole discretion. Winning contestants for both the National Finals Prize and the Grand Prize must execute and return an Affidavit of Eligibility and Release and IRS Form W-9 within seven days of receipt and must meet eligibility requirements as described in Addendum A attached. Return of any prize or prize notification as undeliverable will result in disqualification and an alternate winner will be selected. Failure to return Affidavit of Eligibility and Release and IRS Form W-9 within seven days of receipt may result in prize forfeiture. Winning contestants may be required to sign an image release acceptable to Sponsors in order to claim any prize. Any contestant who does not meet the requirements of these Contest rules may forfeit prizes or be disqualified from the Contest in Sponsors’ sole discretion. Unclaimed prizes may not be awarded to other contestants. No tickets or other travel documentation will be issued in the name of any contestant who has not signed required documents. Sponsors will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Prize is not transferable, assignable, or redeemable for cash. No substitution for the prize by the winner will be allowed. If necessary, due to unavailability of the prize for any reason, a prize of equal or greater value will be awarded at the sole discretion of the Sponsors. Nissan North America, Inc. will issue an IRS Form 1099-MISC to each contestant for the retail value of their prize(s). All federal, state and local tax liabilities related to the receipt of the prize are the sole responsibility of the contestants. Acceptance of a prize constitutes permission (except where prohibited) for the Sponsors to use the contestant’s name, likeness, biography, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation. Employees of the Sponsors and its parent, subsidiaries and affiliated companies and their immediate families are not eligible to participate in this Contest. Neither the Sponsors nor its parent, affiliates, subsidiaries, division or related companies and their respective officers, directors, shareholders, members, manager, employees, agents, and assigns are responsible for any damages, taxes, or expenses that winners might incur as a result of this Contest or receipt of a prize or any portion of a prize.

Contestants agree to release Sponsors and their respective parents, subsidiaries, agencies, divisions, and affiliates and their respective officers, directors, shareholders, members, manager, employees, agents, and assigns from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including property damage, personal injury or death that may occur in connection with, preparation for, travel to, or participation in the Contest, or possession, acceptance or use or misuse of any prize or participation in any Contest-related activity and claims based on publicity rights, copyright or trademark infringement, defamation or invasion of privacy and merchandise delivery. Neither the Sponsors nor their parents, affiliates, subsidiaries, division or related companies or prize providers or event administrators and their respective officers, directors, shareholders, members, manager, employees, agents, and assigns are responsible for any damages, taxes, or expenses that winners may incur as a result of this Contest or receipt of prize.

WINNERS’ NAMES: To obtain a list of winners, send a stamped, self-addressed envelope to: “GT Academy National Finals” Winners List, c/o Marketing Dept., 2207 Bridgepointe Parkway, San Mateo, CA 94404. Winners list requests will be fulfilled within four weeks after all prizes have been awarded. Requests for winners list must be received no later than September 15, 2013.

RESTRICTIONS: Void where prohibited or restricted by law.

Addendum A

Prize Winners must participate in a mandatory health screening for physical fitness and vision prior to the start of the GT Academy Boot Camp and be in good general health in accordance with Motor Sports Association (“MSA”) medical requirements (details can be found here).

Health screening may include:

• Extended Physical, CBC, Chem Panel, Urinalysis, EKG and Spirometry Eyesight test (with glasses or lenses if necessary). Contestants must declare color-blindness, which in extreme cases may preclude a contestant from participation in GT Academy Boot Camp.
• Body mass index and blood pressure exam, including making sure contestants are within the minimum and maximum height and weight restrictions to fit into the cars being used at the GT Academy Boot Camp.
• Free-movement of all joints and confirmation of no serious neck or head injuries.

Contestants are further governed by the following provisions:

Contestant must have a valid United States drivers license.

Contestant may not have either a Driving Under the Influence (DUI) conviction or a Driving While Intoxicated (DWI) conviction.

Contestant must not have any previous felony convictions, including a reckless driving conviction.

Contestants must not have an existing competition driving contract with any motor sports team, body, agent or management company that conflicts with his/her ability to accept the Prize.

Contestants must not have previously held a National A or superior MSA license or equivalent in another Fédération Internationale de l'Automobile (FIA) recognized ASN and not have competed in a national level Karting Championship for more than two full seasons.

Should Sponsor discover at any point during a contestant’s participation in the Contest or the GT Academy that a contestants’ involvement in the Contest or the GT Academy could impair Sponsor’s brand image or risk the safety of others, Sponsor may terminate contestant’s involvement in the Contest or the GT Academy.
